3.1 Registration: You may sign in using your Google account. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.
3.2 Accuracy: You agree to provide accurate and up-to-date information. We may suspend or terminate accounts that use false information.
3.3 One account per person: You may not create multiple accounts to circumvent usage limits, bans, or subscription requirements.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must NOT:
5.1 Ownership: You retain ownership of the photos, videos, and other media you upload ("User Content"). By uploading, you grant us a limited, non-exclusive, royalty-free license to process your content solely to provide and improve the Service.
5.2 Responsibility: You are solely responsible for your User Content. We are not responsible for content uploaded or generated by users.
5.3 Removal: We reserve the right to remove any User Content that violates these Terms or applicable law, without prior notice.
5.4 Generated content: AI-generated outputs are provided for personal, non-commercial use unless otherwise specified in your subscription plan. You may not use outputs for commercial purposes, broadcast, or publication without our written permission.
The App, including its design, software, AI models, graphics, templates, and all associated intellectual property, is owned by us or our licensors and protected by copyright, trademark, and other applicable laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not reproduce, distribute, or create derivative works based on the App without our express written consent.
7.1 Plans: The App offers free and paid (VIP) subscription plans. Premium features require an active paid subscription.
7.2 Billing: Subscriptions are billed through Google Play or other platform billing systems. By subscribing, you agree to the billing terms of the relevant platform.
7.3 Auto-renewal: Paid subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
7.4 Cancellation: You may cancel your subscription at any time through your Google Play account settings. Cancellation takes effect at the end of the current billing period; you will retain access until then.
7.5 Refunds: Refunds are governed by the refund policy of the platform through which you purchased (e.g., Google Play). We do not directly issue refunds except where required by applicable law.
7.6 Price changes: We reserve the right to change subscription prices. We will provide at least 30 days' notice of price changes. Continued use after the effective date constitutes acceptance.
7.7 Credits / Daily quota: Free-tier usage quotas and credits expire at the end of each calendar day and do not carry over. They have no monetary value and are non-transferable.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $10.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.
You agree to indemnify, defend, and hold harmless FaceSwap AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. Upon termination:
You may terminate your account at any time by deleting it through the app or contacting us.
We may revise these Terms from time to time. When we make material changes, we will notify you via an in-app notification or update the "Last Updated" date above. Your continued use of the Service after the updated Terms become effective constitutes your acceptance.
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction in accordance with applicable law.
